Will the Government Ban Delta 9 Vape Products?

The federal government, and more precisely the Drug Enforcement Administration (DEA), might find it hard to ban delta-9 vape products. After all, the Farm Bill explicitly states that hemp products can have as much as 0.3% delta-9!

That delta-9 is THC may work in its favor from a legal perspective. While the DEA could rule against delta-8, HHC, and THC-O products, going after delta-9 would risk torpedoing the hemp market.

The 0.3% delta-9 cap is there so companies can sell whole-plant hemp products – these are more effective than CBD-isolate products. I cannot see how the DEA could ban delta-9 legal highs without affecting the therapeutic full-spectrum CBD market.

That considered, I predict delta-9 vape products will stay legal. And I anticipate these products remaining in high demand until the federal government legalizes marijuana.
