Sure, natural hemp-derived HHC is legal. But it’s the laboratory process and human interference that has courted controversy with HHC and other hemp-based psychoactive substances.

The Drug Enforcement Administration (DEA) has not commented specifically on HHC but has spoken about “synthetic tetrahydrocannabinol,” which remains a Schedule 1 drug.

HHC is a hydrogenated derivative and not an analog of THC. However, the DEA has given us a glimpse into its line of thinking on these grey-area cannabinoids.

As of February 2022, the DEA considers synthetic tetrahydrocannabinol as a substance made with non-cannabis materials. Notably, HHC has a natural basis – it comes from hemp extract! Therefore, it seems the DEA does not view HHC as synthetic.

Of course, that position may change, and other states could enforce their own laws on HHC. Already, several states have made delta-8 illegal. I hope the same doesn’t happen to HHC, but it’s a fluid, ever-changing situation.

While HHC may be less potent than HHC, it’s still psychoactive and demands respect. Whether using HHC e-liquid as a vape juice or tincture, here are some tips to stay safe as you do so.

Even if you’re a regular THC user, take it easy with your first dose of HHC. Get an idea of the effects before moving up to higher amounts. As you increase the dosage, go up in incremental levels and perhaps keep some notes on which quantities work best for you.

When vaping, wait at least an hour before topping up; when taking HHC e-liquid as a tincture, wait a minimum of 90 minutes. Give the HHC time to fully kick in before assessing the effects.
